Copyright and DMCA policy

Copyright infringement is one of the few things we remove, and only after a valid notice. Here is how to send one, and how to respond if your post was removed.

Email is by far the fastest way to reach us. Please put “DMCA notice” in the subject line so it reaches the right person quickly. For anything else, see Contact.

Sending a notice of infringement

The quickest way is our online form. It asks for everything a valid notice needs, emails you a copy, and goes straight to our agent.

Send a copyright notice

Because groups are private, we can't see whether your work appears in one unless you tell us exactly where. If you send a notice by email or mail instead, it must include:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say is infringed.
  3. The specific location of the material on Frendivo, such as the full address of the post (it starts with https://frendivo.com/g/). If you aren't a member of the group, describe it as precisely as you can.
  4. Your name, address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

We remove or disable the material identified in a valid notice and tell the person who posted it, including who sent the notice and which work it names. If a notice is missing something but tells us the work, where the material is, and how to reach you, we'll write back and say what's missing; we can't act on it until it's complete. Knowingly false notices can make you liable for damages under 17 U.S.C. § 512(f).

Sending a counter-notice

If your post was removed and you believe that was a mistake or misidentification, send our agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the removed material and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Frendivo may be found), and that you will accept service of process from the person who sent the original notice.

We forward a valid counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we restore the material 10 to 14 business days after receiving the counter-notice.

Repeat infringers

Frendivo closes the accounts of repeat infringers. Each valid notice we act on against a person is one strike, however many items it names. A strike lasts 12 months. A third strike within 12 months closes the account.

  • A strike is removed if the material is restored after a valid counter-notice.
  • We tell you each time you get a strike, and how many you have.
  • We may close an account sooner for plain, deliberate infringement, such as an account that exists to share pirated material.

We keep notices, counter-notices and strike records for five years after the last action on them.

This is not a censorship tool

A copyright notice can only remove material that copies someone's work. Quoting, criticizing or commenting on a work is often fair use, and a notice that targets an opinion rather than a copy will be refused. See our free-speech promise.
